Booking Terms and Conditions

Please find the booking terms and conditions for all wedding photography and videography packages below.  For the purpose of these booking conditions, references to “you” and “your” are references to the Wedding Couple only and references to “we”, “our” and “us” are references to Emd Media.

  1. CONTRACT:

Please read these booking conditions carefully as they form the basis of your contract with us. Your contract with us will be binding as soon as the non refundable booking fee is paid and you may incur additional charges if you wish to amend or cancel your booking confirmation after issue.

  1. CONTRACTING PARTIES

We will only enter into a contract with the wedding couple (the “Wedding Couple”) and cannot accept any bookings made on their behalf or instructions by any other third party (this includes, but is not limited to, parents and/or other family members and friends).

  1. REVIEW YOUR BOOKING & PRICE:

The  price provided to you at the time of booking (your ‘Wedding  Date’) is confirmed to you in GBP Sterling and can only be paid for in GBP Sterling.

Please check your booking confirmation carefully and report any incorrect or incomplete information to us immediately. It is important that you ensure that names are exactly as stated in the Booking.   These are the spellings that will be used for the front cover of your Wedding Album if you have chosen one to be included in your package.

  1. BOOKING FEE & BALANCE

When you have chosen your wedding Photo / Video Package  and you make a request to us to book it, you will be asked to pay a booking fee which will be non-refundable. Once we have received your fee, no other wedding couple will be able to book that date and therefore it will be held solely for your use.

The Booking Fee is £200 unless otherwise agreed by mutual consent.

If after the booking is confirmed, you wish to add any extras to your wedding or upgrade any services that form part of your wedding photography package you can do so up to 1 month in advance of your wedding date.

The balance of the cost of your wedding Photo Video Package is due 30 days before the wedding date. If payment is not received in time we will remind you that it is overdue. If you fail to pay within 7 days of receipt of the reminder that payment is overdue we will result in us being unable to carry out your Photo or Video services on your wedding day.

  1. YOUR RESPONSIBILITY FOR YOUR BOOKING:

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your entire party the terms of these booking conditions. This means that you are responsible for making all payments due, notifying us of any changes or cancellations that are required and for receiving the booking confirmation and keeping your party informed of any communications from us.  We will contact you by either / all of the following – Whats App – Facebook Messenger – Phone Call – Email.  It is your responsibility to check and reply to all communications from us in a timely and reasonable manner.

Unfortunately we are not able to accept any bookings for wedding arrangements where you are under the age of 18.

  1. INSURANCE:

It is your responsibility to ensure that you/your wedding arrangements are adequately insured. We strongly recommend that you take out insurance, which should include cover against the cost of cancellation by you and assistance in the event of accident or illness.  We are not responsible for other wedding “vendors”  including Hotel Cancellations or limitations being placed upon them due to capacity issues with regards to Health and Safety issues or government advice or restrictions.

  1. IF YOU WANT TO CHANGE YOUR BOOKING:

After our booking confirmation email has been issued, any requests for changes must be sent to us in writing, by email or post, by you. We will do our best to make these changes but cannot guarantee that we will be able to accommodate your request.  If we are available on your new date an admin fee of £50 will be charged to move your date and release the current date to other brides.

  1. IF YOU WANT TO CANCEL YOUR BOOKING:

If you wish to cancel your booking, you may do so at any time, however there will be cancellation fees payable depending on when you cancel the booking.

Cancellation fees:

12 months or more

All deposits and non-refundable advance payments paid to date of notice of cancellation

Less than 6 months

Full price of all confirmed wedding arrangements

*Please note that any cancellation received out of business hours (between 09:00 to 17:30 GMT) will be treated as having been received on the next business day.

  1. IF WE CHANGE OR CANCEL YOUR BOOKING:

It is unlikely that we will have to make any changes to your wedding arrangements. However, as your arrangements are usually planned months in advance, on occasion we may be forced to make changes and we reserve the right to change or cancel your booking at any time if necessary.

Any amendment or cancellation fees you incur in terms of other arrangements you have made with other providers under separate contracts are not claimable from us. Pursuant to above, we strongly recommend that you take out insurance to cover your wedding arrangements or alternative insurance arrangements commensurate with the wedding arrangements made.

If we have to cancel your wedding Photo / Video Service we will refund all monies paid including your booking fee.

  1. BEHAVIOUR:

When you book wedding arrangements through us, you accept responsibility for the proper conduct of all members of your party in respect of your wedding arrangements – if any member of the party’s behaviour is such, in our reasonable opinion, as to cause or to be likely to cause danger, upset or distress to anyone else or damage to our property. Full cancellation charges will then apply and no refund will be payable to you. Furthermore, we shall be under no obligation whatsoever to pay compensation or meet any costs.

  1. DATA PROTECTION:

The personal information that you provide to us about you and your party will be processed by us in order to facilitate your booking, to process your payment for our services and will be held securely on our computer system.

As the data controller, we take steps to ensure that appropriate security measures are in place to protect your personal data.

We will also need to keep your personal information stored securely for as long as reasonably necessary.

We can assure you that your information will be treated with the utmost confidentiality. It will not be sold or made available in other ways to third parties for marketing purposes. You are entitled to a copy of any data we hold about you and to understand why we are holding/processing such data and to whom we have disclosed or may disclose your data to.

  1. IMAGES:

When entering into a contract with us  you to agree on your behalf and on behalf of your entire party that any photographs or video of your wedding may be used by us for our reproduction in any publication, presentation, sales or marketing communication (including email or any other electronic communication) or campaign without limitation and to the extent necessary you license us to utilise any images in whole or in part for any and all such or related purposes. In entering into this contract you agree to bring this clause to your entire party’s attention. Nothing in this clause shall, however, preclude you or any of your party from contacting us to request due to certain special circumstances that this purpose can be removed.

  1. Colour and Reproduction

All image sizes are nominal. The Photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.

  1. Restrictions

For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.

  1. Retouching

All images will be adjusted for exposure, brightness, contrast, sharpness, etc The Photographer’s judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost.

  1. Prints / Re-Orders

All prints and reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

  1. Copyright

The copyright Designs and Patents Acts assign the copyright of the images to the photographer. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer/s in writing.

  1. Licence

The Photographer/s shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

  1. Force Majeure / Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer / videographer will not be responsible for photographs that are not produced due to technical failure.

  1. Attendance

In the unlikely event of the assigned Photographer / Videographer being unable to attend your wedding due to unforeseen circumstances, we will refund all monies paid to you the client.

  1. Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.  We advise you take out appropriate wedding insurance to cover all such possibilities.

  1. Personal Accidents

Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer / videographer cannot be held responsible for any personal accidents during a photographic / video shoot.
